As we become older it becomes more difficult to make decisions and it is advisable to appoint someone you trust as an “Attorney” through a Lasting Power of Attorney (“LPA”). It is prudent to put an LPA in place while you are in good health in case of injury or accident affecting your physical or mental capacity.
An LPA is a legal document allowing you, while you have sufficient mental capacity, to appoint one or more Attorneys who can help to manage your health, well being and financial affairs if and when you lose mental and/or physical capacity or to assist you as and when required. You can also give directions as to how you want your Attorney to make these decisions.
Having an LPA is a safe way of maintaining control over decisions made for you because whomsoever you choose is required to confirm in advance that they understand the significance and purpose of being an Attorney.

The process of preparing and registering an LPA can be complicated and protracted and the completed document must be registered with the Office of the Public Guardian before it can be used.
